Terms of Service
Effective date: August 24, 2026.
These terms are between you and Honest Scooper by N. Malyshev ("Honest Scooper", "we", "us"), a sole proprietorship operating a dog-waste removal service in the South Bay, California. You accept them when you submit a service request or activate service — each of those steps asks for your explicit confirmation. Browsing the site, or calling or texting us, does not by itself create an agreement; our Privacy Policy covers the information you share when you do.
1. The service
Yard visits on your scheduled day, weekly or every two weeks, or a one-time cleanup. We remove dog waste from the accessible yard, double-bag it into your own outdoor bin, latch the gate, and email you a confirmation when the visit is done. Pricing is per completed visit by dog count, as published on the site or quoted to you by text.
2. Text messaging program
Submitting the service-request form authorizes one transactional text confirming that we received the request. That reply does not confirm a start date. Separately, checking the optional SMS box authorizes ongoing service and account text messages from Honest Scooper at that number: scheduling, access, and visit confirmations. Activation links go by email — and also by text if you opted into texts; paid Invoices, receipts, and monthly summaries go by email. Starting a text conversation with us also authorizes replies to that conversation. These are transactional messages, not marketing. Message frequency varies with your service. Message and data rates may apply. Carriers are not liable for any delayed or undelivered messages. Consent to ongoing texts is not a condition of submitting a service request. Reply STOP at any time to opt out and we will stop sending; reply HELP for help or call (669) 330-4664. 3. Access, gates and dogs
You agree to give us access to the yard on your service day. We never climb fences or force gates. If the gate is locked or blocked, we text you from the driveway and wait a few minutes. If we still cannot get in, that visit is not charged. After a second access problem, future service pauses until you confirm access. Friendly dogs can stay outside if you tell us in advance. If a dog is unsure about us, we text you and come back another day rather than push it. Please keep protective dogs inside during your service window.
4. Our reliability promise
If we do not show up on your scheduled day and have not rescheduled with you by text, that visit is free and we make it up within the same week. The guarantee does not cover visits we could not complete because the yard was not accessible (locked gate, blocked access, a loose dog). Light rain: we work. Dangerous weather (storms, flooding, a heat advisory): we text you and make the visit up within the same week. We never silently skip a yard.
5. Billing, holds and cancellation
No contract and no signup fee. The $49 first cleanup asks you to plan on four weekly visits, but if you stop sooner we do not bill you for the difference. Start any week. Each completed visit gets its own automatically collected Stripe Invoice and paid receipt by email. At month-end you get a summary listing completed, skipped, and inaccessible visits; it is informational and has nothing due. By activating service, you authorize one automatically collected Invoice after each chargeable completed visit at the exact rates shown during activation. A failed collection is not retried blindly: service pauses until you use the secure recovery flow to authenticate or update the payment method and retry that same Invoice. Optional tips are separate one-time payments, never preselected, required, recurring, or added to a service Invoice. Cancel or skip any week by text up to 8pm the day before your visit, with no fee and nothing to fill in. You may also cancel future service immediately through your secure management link; completed work may still have a disclosed final Invoice. Skip weeks by text. Holds of up to four weeks keep your rate and your route slot; after a longer hold you can rejoin at the current published rate. Prices may change with 30 days' notice.
6. Founding rate
If we receive your weekly or every-two-weeks service request on or before September 15, 2026, the recurring per-visit rate shown in that dated request confirmation is reserved when we receive it. That rate applies when you later approve the exact date and price, save a payment method with Stripe, and activate service, and it stays locked while service remains continuously active. The request does not itself book or schedule a first visit or create a charge. Holds of up to four weeks count as active after service starts. If you cancel or pause for longer, you are welcome back at the then-current published rate. Adding a dog moves you to the founding rate that was published for the new dog count on the date of your request. A founding rate is not affected by later price changes: as long as your service stays continuously active, the 30 days' notice in section 5 does not apply to you.
7. Gate codes
Gate codes are stored encrypted, shown only to the person doing your visit, never included in notifications, and deleted within 30 days after service ends. Change or remove your code any time by text.
8. Liability
We are responsible for damage or injury we cause. That includes a gate we failed to latch. We are not responsible for pre-existing yard conditions, for damage we did not cause, or for a pet that leaves through a gate or opening that was not ours to close.
Our total liability for any claim is limited to the amount you paid us in the three months before the event, except where California law does not allow that limit — including liability for death or personal injury caused by our negligence, and liability for gross negligence, willful misconduct, or fraud, none of which is capped. Nothing in these terms limits any liability that California law does not allow us to limit.
9. Refunds
If a completed visit did not meet the written promise on this site, tell us within 7 days of that visit and we will, at your choice, refund that visit's Invoice in full or credit your next visit. Refunds go back to the original payment method through Stripe. Skipped, cancelled, and inaccessible-yard visits are never charged, so there is nothing to refund for them. Nothing in this section limits any right you have under California law.
10. Disputes and changes
California law governs these terms; disputes go to the courts of Santa Clara County. If these terms change, the new version appears here with a new effective date, and we notify active customers by email before it applies to them; continuing service after that notice means acceptance of the new version.
